Purposes of Processing

The personal data we collect will be processed for the following purposes depending on the context of collection:

• Customer Service / Contact: To respond to your inquiries, requests and provide the requested services.
• Newsletter subscription: To manage the sending of commercial information about our products and services via regular mail, email, or SMS.
• Reservations: To manage and process the reservations made.
• Internal Statistics: The data may be used for the elaboration of internal statistics that allow us to improve our services.
• Provision of Services during the Stay: In our facilities, the data will be used to manage and provide the requested services, such as excursions, spa, wellness, among others.

Conservation period

Personal data will be kept for the duration of the contractual relationship. Once the contractual relationship has ended, they will be blocked and will only be kept for the legally established period in order to respond to possible claims. At the end of this period, they will be definitively deleted. The data for sending commercial information will be kept as long as you do not request its deletion.

Legitimation of Processing

The legal basis for the processing of your data is the performance of a contract and the fulfillment of legal obligations arising from the contracted services. For all other purposes, the processing is based on your consent, which you may withdraw at any time without affecting the lawfulness of the previous processing.

Protection of Minors

Children under the age of 14 cannot consent to the processing of their data; only their parents or guardians can do so on their behalf.

Security and Confidentiality Measures

MALBA NEPTUNO, SL has implemented appropriate technical and organizational measures to protect your personal data, in accordance with the RGPD, the LOPDGDD and the applicable regulations on information society services and telecommunications. We are committed to maintaining the confidentiality of your data even after the end of the contractual relationship.

Transfer of Data to Third Parties

Your data will not be disclosed to third parties unless required by law or when necessary for the provision of contracted services. In application of current legislation, guest data will be communicated to the State Security Forces and Corps when checking in at the hotel.

Categories of Data Processed

The data processed includes identification data (name, surname, ID/passport number, telephone, address, email) and financial data (credit/debit card).

International Data Transfers

No international transfers of your data will be made.

Consent and Data Update

Unless you tell us otherwise, we will consider that your data have not changed and that you consent to their use for the above purposes. Sending your data through the forms on our website implies acceptance of this privacy policy, confirmed by checking the acceptance box prior to sending your data.

User’s rights

You have the right to access, rectify, delete, oppose, limit the processing and request the portability of your data. You can exercise these rights by sending a request to lopd@hotelneptuno.com. In the request, you must provide sufficient details to identify your case, and only in cases of reasonable doubt about your identity, we may request additional information to verify it.
In addition, you can go to the website of the Spanish Data Protection Agency (www.aepd.es) to obtain standardized forms that will assist you in exercising your rights. The company will respond to your request within the legally established period.

Data Protection Delegate (DPD)

Should you wish to file a complaint regarding the processing of your personal data, you may contact the Data Protection Officer of MALBA NEPTUNO, SL by sending an e-mail to dpd@hotelneptuno.com. The DPD is available to deal with any query, complaint or request for further information about the processing of your personal data.

Complaints to the Control Authority

Similarly, if you consider that your rights have not been adequately addressed or that there has been an infringement in the processing of your personal data, you have the right to file a complaint with the Spanish Data Protection Agency (AEPD).
